Terms of Service

These Terms of Service (these "Terms") govern use of the Android application "Poppin" (the "App") and the website poppin-studio.com (the "Site"; together with the App, the "Service") provided by Poppin Studio ("we", "us", "our"). By using the Service, you (the "User") agree to be bound by these Terms.

1. Application

  1. These Terms apply to any and all relationships arising in connection with use of the Service.
  2. Any additional rules and notices that we publish within the Service form part of these Terms.
  3. In the event of a conflict between these Terms and such additional rules, the additional rules prevail.

2. The Service

The App is an Android application that provides flashcard study and spaced-repetition scheduling features, along with a feature that measures the time you spend in other applications you have designated and, when certain conditions are met, displays a study prompt ("Pop Quiz"). The specific features, specifications, and operating conditions of the App are documented on its Google Play listing and other locations we may designate.

3. Conditions of Use

The Service is intended for use on Android devices. The User uses the Service at their own risk and accepts all consequences of that use.

4. Prohibited Conduct

The User must not engage in any of the following in connection with the Service:

  1. any act that violates applicable law or public order and morals;
  2. copying, modifying, adapting, redistributing, selling, renting, reverse-engineering, decompiling, or disassembling the App (except to the extent expressly permitted by applicable law);
  3. interfering with normal operation of the Service or otherwise causing loss or detriment to us or to any third party;
  4. using any feature of the App, including Pop Quiz, beyond the scope of the User's own study purposes that the User has configured, to obstruct normal use of an application on the device of another person, against that person's will (for the avoidance of doubt, a User's own continued use of Pop Quiz on target apps and conditions that the User has configured for their own study is not conduct prohibited by this item);
  5. providing false information in the course of registration;
  6. infringing any intellectual-property or other rights related to the Service;
  7. any other conduct that we reasonably determine to be inappropriate.

5. User Content

  1. Decks, cards, and any associated media files that a User creates or imports in the App ("User Content") remain the property of that User or the applicable rights-holder.
  2. We do not receive any User Content. User Content is stored solely on the User's device.
  3. The User represents and warrants that their User Content does not infringe any third-party right, and shall resolve at their own cost and responsibility any claim of infringement asserted against such User Content.

6. Advertising

The App displays advertisements through Google AdMob. Advertising revenue funds the operation of the Service. Ads-personalization can be adjusted from your Android device's advertising settings. Details of the handling of the Advertising ID and other information in connection with ad delivery are set out in the Privacy Policy.

7. Exclusion of Antisocial Forces

  1. The User represents and warrants that the User is not, and has no relationship of any kind with, any organized crime group, member or associate member of an organized crime group, corporate racketeer (総会屋), or any person or entity of a similar nature (collectively, "Antisocial Forces").
  2. If we determine that a User has breached the representation and warranty in the preceding paragraph, we may suspend that User's use of the Service without prior notice.

8. Disclaimer

  1. The Service is provided "as-is". We make no warranty, express or implied, as to completeness, accuracy, reliability, usefulness, fitness for a particular purpose, or continued availability of the Service.
  2. Except in cases of our wilful misconduct or gross negligence, we are not liable for any damages arising from the User's use of, or inability to use, the Service, including loss of profits, lost business opportunity, or loss or corruption of data.
  3. To the extent permitted by applicable law, where we are found liable, our aggregate liability is limited to the amount the User actually paid to us for the feature that gave rise to the damage.

9. Changes, Suspension, Termination

We may temporarily suspend the Service for maintenance, incident response, or other operational reasons. We may also modify the content of the Service, or suspend or terminate the Service, at any time without prior notice, and are not liable for any resulting damages to the User or any third party.

10. Changes to these Terms

We may revise these Terms from time to time without prior notice. Revised Terms take effect when posted on the Site. Material changes will be announced separately in the App or on the Site.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the district court having jurisdiction over our address, as the court of first instance.
